Terms of Service

These Terms of Service govern your use of FamiNest, including its mobile applications, background monitoring features, cloud services, and related functionality. By accessing or using FamiNest, you agree to be bound by these Terms.

1. About FamiNest

FamiNest is a parental control and family device management service. It allows a parent to register and sign in, link a child device using a pairing code, monitor device-related activity, and send control commands such as app blocking, screen-time controls, and scheduled restrictions.

2. Eligibility

You may use FamiNest only if you are legally permitted to enter into a binding agreement under applicable law. If you use FamiNest as a parent or guardian, you represent that you are authorized to manage and supervise the linked child device.

3. User Roles

  • Parent: Signs in using Google Authentication, manages children, links devices, configures rules, and sends control commands.
  • Child Device: Does not require a separate account, is identified by the device and pairing flow, and may run background services required for monitoring and enforcement.

4. Device Pairing and Linking

Parent-child linking is performed using a temporary pairing code. Pairing codes may expire automatically and may only be used as permitted by the application. You are responsible for keeping pairing codes secure and using them only for devices you are authorized to link.

5. Acceptable Use

You agree that you will not:

  • Use the service for unlawful surveillance or monitoring.
  • Use the service without required consent under applicable law.
  • Attempt to interfere with, disrupt, or reverse engineer the service.
  • Use FamiNest to send abusive, fraudulent, or malicious commands.
  • Attempt to access data, devices, or accounts that do not belong to you.
FamiNest is intended for lawful parental supervision and family device management only. You are solely responsible for ensuring your use complies with local law.

6. Permissions and Device Features

Some FamiNest features require elevated Android permissions or system capabilities, including but not limited to usage access, accessibility, overlay permissions, notification access, battery optimization exclusions, or background service execution. Certain features may not work properly unless these permissions are granted.

7. Subscriptions and Payments

FamiNest may offer monthly and yearly subscription plans through Google Play. Billing, renewal, cancellation, refunds, and payment processing are handled in accordance with Google Play policies and any applicable law.

  • Subscriptions may renew automatically unless canceled.
  • Prices may change where permitted, with notice where required.
  • Refund requests are subject to Google Play's rules unless otherwise required by law.

8. Service Availability

We do not guarantee uninterrupted availability, real-time delivery of commands, or compatibility with all Android devices, manufacturers, operating system versions, or system restrictions. Some functionality may be limited by device hardware, OEM settings, battery restrictions, or third-party platform changes.

9. Account Security

You are responsible for maintaining the security of your Google account and any device used to access FamiNest. You are responsible for activity that occurs through your account, except to the extent caused by our own failure to apply reasonable security measures.

10. Data and Logs

FamiNest may process configuration settings, linked device information, device status, commands, acknowledgements, and monitoring-related logs in order to operate the service. Our handling of personal information is described in the Privacy Policy below.

11. Intellectual Property

FamiNest and its related software, branding, interfaces, content, and technology are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.

12. Suspension and Termination

We may suspend, restrict, or terminate access to FamiNest if we believe you have violated these Terms, used the service unlawfully, created risk for other users, or interfered with the service. You may stop using the service at any time.

13. Disclaimers

FamiNest is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that the service will be error-free, secure, continuously available, or suitable for every particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from or related to your use of FamiNest. Where liability cannot be excluded, it is limited to the amount you paid for the service during the 12 months before the event giving rise to the claim.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date. Your continued use of FamiNest after the updated Terms take effect means you accept the revised Terms.

Privacy Policy

This Privacy Policy explains how FamiNest collects, uses, stores, and shares information when you use our parental control and family device management service.

1. Scope

This Privacy Policy applies to the FamiNest mobile application, related background services, and our backend systems used to support authentication, device pairing, monitoring, and command delivery.

2. Information We Collect

Depending on how you use FamiNest, we may collect the following categories of information:

  • Parent account information: name, email address, and Google account identifier used for sign-in.
  • Child device information: device ID, device name, manufacturer, model, brand, OS version, SDK version, app version, and pairing status.
  • App and device management data: installed applications, app identifiers, block status, schedules, screen-time settings, and sync state.
  • Commands and operational logs: commands sent by a parent, acknowledgement status, timestamps, and diagnostic logs.
  • Realtime status data: connection state, device activity relevant to service functionality, and service heartbeat or command processing state.
  • Subscription and billing data: limited transaction-related information provided through Google Play. We do not receive or store full payment card numbers.

3. Permissions and Sensitive Access

FamiNest may request access to Android permissions and device capabilities that are necessary to provide parental control functionality. These may include usage access, accessibility features, foreground/background service operation, display over other apps, notification access, and similar system-level permissions. We use these permissions only to provide features you enable, such as monitoring app usage, enforcing app restrictions, applying schedules, or operating supervision tools on the linked child device.

4. How We Use Information

  • To authenticate parents and manage accounts.
  • To pair, identify, and manage linked child devices.
  • To deliver parental control commands and apply configurations.
  • To show device, app, and activity information in the parent interface.
  • To maintain service security, integrity, and reliability.
  • To improve performance, troubleshoot errors, and support users.
  • To manage subscriptions and enforce access to paid features.
  • To comply with legal obligations and enforce our Terms.

5. Legal Basis and Consent

By using FamiNest, you represent that you have the authority and any required consent to install, configure, and use the service for the linked child device. You are responsible for ensuring your use of FamiNest is lawful in your jurisdiction.

6. How We Store Information

We use cloud infrastructure and service providers, related Google Cloud services, to store and process data required to operate FamiNest.

7. How We Share Information

We do not sell your personal information. We may share information only in the following circumstances:

  • With service providers and infrastructure partners that help us operate FamiNest.
  • When required by law, regulation, legal process, or governmental request.
  • To protect the rights, security, and safety of users, our service, or others.
  • In connection with a merger, financing, acquisition, or sale of assets, subject to applicable safeguards.

8. Data Retention

We retain information for as long as reasonably necessary to provide the service, meet legal obligations, resolve disputes, enforce agreements, and maintain operational records. Pairing codes and temporary operational data may expire or be deleted automatically.

9. Security

We use reasonable administrative, technical, and organizational safeguards to protect information. However, no system can be guaranteed to be completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

FamiNest is intended to be used by parents or guardians to manage child devices. The child device itself may not require a standalone account, but data associated with that device may still be processed to provide the service. Parents or guardians are responsible for ensuring they have appropriate rights and permissions to use the service for the child device.

11. International Data Processing

Your information may be processed and stored in countries other than your own, depending on the location of our service providers and infrastructure. By using FamiNest, you understand that data may be transferred across borders, subject to applicable safeguards.

12. Your Choices and Rights

Depending on your location and applicable law, you may have rights to access, correct, delete, or restrict certain personal information. You may also be able to stop certain data collection by uninstalling the app, unlinking devices, or disabling permissions, though doing so may limit functionality.

13. Third-Party Services

FamiNest relies on third-party services such as Google Sign-In, and Google Play billing. Your use of those services may also be governed by their own privacy terms and policies.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of FamiNest after an update means you accept the revised Privacy Policy, to the extent permitted by law.
